From 30 October 2026 every worker must receive written information about their right to join a trade union. Recognised unions can also apply for access to the workplace, physical or remote, to meet workers.
Editorial comment
For small Polish businesses in the UK, especially in construction, hospitality, retail and services, the first change is the most dangerous. A former employee now has six months to bring a claim, so the records of every disciplinary meeting and every dismissal must be complete. The second change hits customer-facing sectors: restaurants, shops, care. A simple written procedure and training are needed.
What to do
- Add written information about the right to join a trade union to contracts and documents for new staff. Deadline: 30 October.
- Write a policy against harassment, including by customers, and show it to your staff. Templates and guidance are on the Acas website.
- Train your shift managers. Keep proof of the training: the date and an attendance list.
- Keep notes of meetings, appraisals and dismissals for at least several years. A claim may come as much as six months after the event.
- If you employ people without an HR department, consider an hour’s consultation with an employment law adviser before the end of October.
