On Wednesday's "Graffiti" programme on Polsat News, Deputy Speaker of the Sejm Krzysztof Bosak and KO parliamentary club leader Zbigniew Konwiński spoke about the Constitutional Tribunal dispute. The first proposes withdrawing police from the Tribunal and amending the constitution, the second defends the election of eight judges. We present both positions side by side.

News

On Wednesday 4 November, on Polsat News’s morning programme “Graffiti”, two politicians from different sides spoke about the dispute over the Constitutional Tribunal (TK). Deputy Speaker of the Sejm Krzysztof Bosak (Konfederacja) presented his idea for ending the crisis. KO parliamentary club leader Zbigniew Konwiński defended the Sejm’s election of eight judges.

Analysis

Krzysztof Bosak proposes several steps: withdraw police from the Tribunal grounds and let all judges into the building, including the president and vice-presidents. He believes Bogdan Święczkowski should be able to serve as president. He also wants vacant seats on the Tribunal filled and judges elected by the Sejm sworn in by the President. He proposes amending the constitution on how judges take their oath because, as he says, the provisions are “written imprecisely”.

Zbigniew Konwiński said KO would not challenge the election of the eight judges, because they were lawfully elected by the Sejm. He called the idea of a “reset” at the Tribunal unrealistic. He said Tribunal President Święczkowski fears losing his immunity.

What it means

Both sides say it is the other that is breaking the law. Some believe the Tribunal president was removed unlawfully, others that the action taken against him is lawful. The dispute is about who currently heads the Tribunal legally.

Risk

While the dispute continues, the status of some Tribunal rulings is uncertain. For ordinary people, nothing changes for now in everyday official matters. We need to watch, wait and stay safe.

What to do

  • Watch the full material and compare it with statements from the other side.
  • Check information in several sources before sharing it.
  • Do not get drawn into online quarrels – talk respectfully.
  • Have a case in a Polish court? Ask your lawyer whether the Tribunal dispute affects it.

How to read this

These are statements by politicians, not court rulings. We present them side by side so that everyone can judge for themselves. More coverage from both sides can be found in the “TK” block on the Polish homepage.
